Branded DISC Personality Profile Service
- Terms and Conditions

The following terms and conditions apply to you as a subscriber to the Branded DISC Personality Profile Service. The service is offered by Personality Insights, Inc. using the DiscoveryReport.com technical platform. For service implementation purposes, the website PesonalityService.com is used. Therefore, this document will refer to "Personality Service" as representative of Personality Insights, Inc. and DiscoveryReport.com and all related intellectual property and copyrighted content.

Content Ownership:

  1. All copyrighted and trademarked content remain the property of Personality Service, including but not limited to the content of all reports and website user interface content related to the report processing system.
  2. The report processing system and all of its functionality remain the intellectual property of Personality Service.

Branding and Personalization of Reports:

  1. Subscribers may use their own logo and cover graphics on the reports as long as they have the rights to use the logos and graphics.
  2. Subscribers must provide legitimate contact information to appear on the cover page including a means of contact for customer support.
  3. Subscribers may select a name for their reports to appear on the cover page of the reports as long as the name complies with copyright and trademark laws.
  4. Personality Service will not be responsible for monitoring the copyright compliance of the logos, graphics or naming of the branded reports by any subscriber, as the subscriber assumes full responsibility for those items.
  5. Subscribers may not choose report names that use "Discovery Report" or "Personality Insights" verbatim in the name of the report.

Advertising and Search Engine Marketing Practices:

  1. Subscribers may advertise online using pay per click (PPC) advertising on websites such as Google, Yahoo, Bing and Facebook, but no advertising may directly refer to Discovery Reports or Personality Insights.
  2. Subscribers may not use trademarked or copyrighted content owned by Personality Service on his or her website without express written permission from Personality Service. Restricted terms include but are not limited to the following examples: Discovery Report, Personality Service, BOTS, Get Real, Positive Personality Profiles, Personality Insights, Robert Rohm, The Model of Human Behavior, Personality Service.
  3. No trademarked or copyrighted words or phrases may be used as part of a subscribers website urls (example:  yourwebsite.com/discoveryreport/personality-test/

Retail Report Pricing:

  1. Reports are not to be sold  online for less than the established retail pricing as set forth in the subscribers resource center (password protected login area provided to subscribers). The current pricing ranges from $12.95 to $69.95 per report depending on the version of report.
  2. Reports may be purchased by subscribers at their established wholesale pricing (equivalent to the retail price minus the subscriber's commission level).
  3. No prior discount agreements with Personality Insights, Inc. or DiscoveryReport.com are binding to this agreement or with this service.

Branded Report Subscription Service Pricing:

Subscribers may either pay for the service monthly or yearly including any applicable setup and activation charges as stated online. The current options are listed online at https://www.personality-insights.com/mybrand/

Commission Payments on Retail Sales:

  1. Subscribers who use the automated ecommerce features of the service may qualify to receive a commission payment for all retail sales. The total monthly payment will be based on the total retail sales for the calendar month. Please note that wholesale purchases made online using wholesale discount codes or purchased in any other manner do not qualify for commission payments.
  2. A subscriber must be in good standing with Personality Service and be current in their service renewal to be eligible to receive commission payments. Outstanding commission balances will be paid to subscribers who renew within 30 days (grace period) of their renewal due date. Otherwise, commission balances will be forfeited by subscribers who are delinquent in paying membership renewal charges.
  3. Commission rates are based on the following categories of subscribers:
    1. Regular subscribers who have not been trained by Personality Insights, Inc. (Insights Institute) in DISC: 25% of the monthly retail sales. Retail sales do not include purchases made online using wholesale discount codes.
    2. Trained subscribers who have completed an authorized DISC training course (2-4 days) with Personality Insights, Inc.: 40% of monthly retail sales.
    3. Special case subscribers may be considered by Personality Service on an individual basis.

Purchase Minimums:

  1. There are no retail or wholesale report purchase minimums. The only financial obligation for subscribers is the ongoing subscription membership charge for the service (monthly or yearly depending on the plan chosen by the subscriber).

Subscriber Eligibility:

A person who subscribes to the service will be considered eligible as long as he or she agrees to:

  1. Comply with the terms of this agreement.
  2. Is not considered to be in direct competition with Personality Insights, Inc., DiscoveryReport.com or PersonalityService.com

Subscriber Claims, Practices and Release of Liability:

  1. Subscribers are not to make any claims for clinical or psychological use of the reports such as for the diagnosis or treatment of a medical disorder. Reports may be used for personal feedback and self-evaluation for such purposes as personal growth, self-improvement or relationship advice.
  2. Subscribers hold Personality Service and all associated personnel and contractors free of any liability associated with the use of the service or sale and use of reports. Personality Service makes no claim or guarantee of profitability or measure of success to any subscriber.
  3. Reports are not to be sold on any website which also offers what are considered to be unprofessional or non-credible resources such as horoscopes, fortune telling, astrology, etc.

End User Information:

  1. DISC profile assessment end user names and email addresses will remain the property of the subscriber and will not be marketed to by Personality Service except for cases where
    a) the end user was already in the Personality Insights or DiscoveryReport.com database or
    b) the end user makes a subsequent direct purchase from Personality Insights or DiscoveryReport.com independent of the subscriber.
  2. Reasonable efforts will be made by Personality Service to keep subscriber's end users/customers isolated from Personality Insights related websites. The intent is to protect the subscriber's business.  This will be accomplished by using a third-party website, personalityservice.com, as the name associated with payments ("Personality Service in Marietta, GA" ) and as a website portal location to enter service access codes.
  3. Subscriber information will be displayed prominently on the system to end users for the benefit of highlighting the subscriber's branding. While copyright information will remain on all reports, it will be displayed in a small font at the bottom of the pages. No overt references will be made to Personality Insights. Subscribers should be aware that users who endeavor to and are capable of looking at the underlying website "code” may uncover discoveryreport.com as the service platform. Again, reasonable measures are in place to cloak the platform in the interest of keeping the subscriber’s customers attention on the subscriber’s brand.

Security of Data:

  1. Secure connections using SSL will be employed whenever customer data is involved.
  2. User data will be stored in a database that is password protected on a secure server that employs a firewall.
  3. All subscriber back-office accounts are password protected.
  4. No credit card data is stored on our servers. Instead, we use third party payment processors who securely store payment data.
  5. PersonalityService.com will undergo regular scans to remain PCI compliant.
  6. End user data will be deleted by direct request of an end user to maintain compliance with GDPR requirements and to respect any privacy concerns.

Duration and Termination:

  1. Subscribers are free to end their service agreement with Personality Service at any time by email notification to support@personalityservice.com.
  2. All setup charges are non-refundable.
  3. Annual plan and multi-year membership charges may be refunded after the first period of service based on the prorated number of days remaining for the subscription period.
  4. Commission balances are to be paid within 60 days of receipt of the termination notice as long as the subscriber is in good standing with the company (which includes membership renewal charges have been paid and no agreement terms have been violated).
  5. Personality Service reserves the right to terminate this agreement with any subscriber who knowingly violates these terms or are suspected of being engaged in illegal practices or engaging in targeted competition with DiscoveryReport.com or Personality Insights, Inc.
  6. Personality Service reserves the right to terminate this service if it becomes financially nonviable to continue the service. Reasonable attempts will be made by Personality Service to give such notice to subscribers 90 days in advance of the end of the service unless prohibited by significant unforeseen factors (catastrophic events, legal regulations etc.).
  7. Subscribers who terminate the service or who are deactivated due to non-payment may reactivate an account for $99. Any previously forfeited commissions, referral payout or other payouts will not be eligible for payment or reinstatement upon reactivation.
